Welcome to Affluence Media, a subsidiary of TriVergeTech Pvt. Ltd. These Terms and Conditions ("Terms") govern your access to and use of our services, including but not limited to our websites (affluencemedia.in and affluencemedia.one), influencer marketing services, brand campaigns, content delivery, digital tools, and any other services provided under the Affluence Media brand.
1. Acceptance of Terms
By using our platforms or services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services. These Terms form a legally binding agreement between you and TriVergeTech Pvt. Ltd.
2. Company Identity
Affluence Media is a brand of TriVergeTech Pvt. Ltd., a company registered in India under the Companies Act, 2013. The brand focuses on influencer discovery, influencer management, digital media campaigns, and brand collaboration strategies tailored to modern digital marketing ecosystems.
3. Definitions
- "Influencer" refers to any individual who registers or collaborates with Affluence Media to promote brand content.
- "Brand" means any third-party organization using our services to collaborate with influencers or promote their offerings.
- "Service(s)" includes all web-based tools, content, and services provided by Affluence Media under its official domains.
4. Eligibility
To access and use our services, you must be at least 18 years old or have obtained parental/legal guardian consent. You must have the full power and authority to enter into these Terms and be fully able and competent to comply with the terms, conditions, obligations, affirmations, representations, and warranties set forth herein.
5. Registration
In order to access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed. You are responsible for safeguarding your password and other login credentials.
6. Scope of Services
Affluence Media provides services such as influencer onboarding, brand matchmaking, campaign management, analytics reporting, long-term management, and content production guidance. The scope of service per user or brand will depend on the chosen engagement type and agreement.
7. Influencer Obligations
- Must create and publish content in accordance with campaign briefs, ethical standards, and applicable laws.
- Must disclose all paid partnerships clearly (e.g., using hashtags like #Ad or #Sponsored).
- Must not post plagiarized, offensive, misleading, or prohibited content.
- Must follow the timeline provided for content submission and go live deadlines.
8. Brand Responsibilities
- Must provide complete campaign information, payment structure, and deadlines prior to campaign execution.
- Must ensure prompt payment after completion or approval of deliverables.
- Must not misuse influencer content without authorization or license.
- Should respect influencer boundaries, feedback, and collaboration agreements.
9. Content Ownership
Unless explicitly stated in an agreement, influencers retain full ownership of the content created. However, Affluence Media and brands are granted a non-exclusive, royalty-free, perpetual license to reuse, repost, and adapt the content on social media and marketing platforms unless agreed otherwise.
10. Exclusivity and Non-Compete
Affluence Media reserves the right to offer exclusivity terms to influencers and brands. During an active exclusive contract, you may not participate in conflicting or competitive collaborations without prior written permission.
11. Payments and Commission
All financial terms, including influencer payouts and commissions retained by Affluence Media, will be communicated in advance and agreed upon through digital or written contract. Influencers are responsible for reporting their income as per tax regulations.
12. Taxation and Compliance
We comply with Indian tax laws including GST and TDS deductions. Influencers and brands must ensure they share valid PAN, GSTIN, and bank account details to facilitate timely and lawful transactions.
13. Confidentiality
Users agree not to share internal communications, campaign briefs, influencer pricing, or proprietary information of Affluence Media or TriVergeTech Pvt. Ltd. publicly or with third parties without prior consent. Violation may result in legal consequences.
14. Platform Conduct
- You agree not to impersonate others, use fake accounts, or mislead users.
- You may not use our platform to spread misinformation, spam, or conduct phishing/scam activities.
- Users must refrain from attempting to breach platform security or access restricted areas.
15. Intellectual Property
All trademarks, visual assets, platform design, and creative content published under Affluence Media and TriVergeTech Pvt. Ltd. remain the intellectual property of the company unless stated otherwise. Unauthorized use or duplication is strictly prohibited.
16. Liability
Affluence Media is not liable for indirect losses, including business interruption, loss of earnings, or data loss. The user assumes full responsibility for decisions made based on information or opportunities provided through our service.
17. Indemnity
You agree to indemnify and hold harmless Affluence Media, its parent company, affiliates, officers, and staff from any legal claims, damages, or third-party demands resulting from your violation of these Terms or misuse of the service.
18. Service Modifications
We reserve the right to change, suspend, or terminate any service feature at any time without prior notice. We also reserve the right to update these Terms periodically. Continued use of our services constitutes your acceptance of any updates.
19. Governing Law
These Terms are governed by the laws of India. In the event of any dispute, parties agree to resolve the issue under the jurisdiction of courts located in New Delhi, India.
